MISSPRINT DI VALENTINA COMANDA (hereinafter Missprint) with registered office in ANZIO, Viale Antium, 6 VAT number 11246241001 CF CMNVNT80D49A323I, in the name and on behalf of the legal representative Valentina Comanda, is a company that designs, produces and sells graphic products, paper printing and various materials for private individuals, businesses and related to the world of events: wedding invitations, baptisms, and ceremonies in general.
BY PURCHASING OUR PRODUCTS THE PURCHASER DECLARES TO HAVE KNOWN AND TO ACCEPT THE FOLLOWING GENERAL CONDITIONS OF SALE PRESENT ON THE WEBSITE WWW.MISSPRINT.IT
1. PREMISE: PURCHASE METHODS
The products can be purchased directly at the Missprint headquarters, or through authorized retailers or through the website www.missprint.it or websites linked to it and only by following the procedure indicated therein step by step. On the site, through the configuration procedure, the Buyer can customize the invitation template he prefers, combining colors, styles, paper and materials and coordinates. At the end of the configuration, the Buyer can decide whether to save the estimate data (point 2), order a paper sample (point 3) or proceed with the purchase of the product (point 5)
SAVE THE ESTIMATE DATA
The data provided to MISSPRINT will be processed in accordance with Legislative Decree. 196/2003 “PERSONAL DATA INFORMATION CODE”, as described in point.
3. SAMPLE OF THE MISSPRINT MODEL CHOSEN FROM THE CATALOGUE IN THE BOUTIQUE SECTION.
The Buyer can request a sample of the model chosen from the catalogue and make colour changes or small variations that do not involve remaking the sample. This sample will be of a generic colour and graphic style that will only represent the chosen paper structure, and will have a shipping cost. Sending the chosen sample will allow the customer to evaluate the product and will not constitute an obligation to purchase in any way. In the case of invitations created with the configurator, it is not possible to request a free sample of the invitation created, this request falls under point.
4. MISSPRINT PROTOTYPE SAMPLE.
The prototype, unlike the catalog sample, is the result of a customized design by our team of graphic designers or is a participation created by the configurator. The Buyer can request a prototype of the model and make color changes or small variations that do not involve remaking the prototype. The prototype will be made based on the approved graphic layout and will cost € 50.00.
5. PURCHASE OF THE PRODUCT
A) The customer, who purchases on the site www.missprint.it, once the configuration phase is complete, if he intends to proceed with the purchase, is required to pay the entire amount, as summarized in the specific "quote page". This payment can be made according to the methods described in point . The payment confirmation will start the actual processing of the order, according to the methods described below
B) Processing of the order in the Boutique section:
B1) The Buyer, after making the payment, will receive from MISSPRINT access to the page for filling in the data and texts relating to the participation ordered, through which he/she can enter all the information he/she wishes to be printed on the participation.
B2) Once this information has been confirmed and sent to MISSPRINT, MISSPRINT will provide the Buyer with a digital preview of the print (in PDF format), which constitutes a FAC-SIMILE of the finished product.
B3) The Buyer may report any errors in the digital preview until the final confirmation of the texts. Approval of the contents constitutes for MISSPRINT consent to the execution of the work (printing and possible assembly), therefore with this "final approval of the preview" the selection process is considered complete and from that moment MISSPRINT, for the production of the product, will refer, only and exclusively, to what has been approved.
B4) Any changes and/or requests subsequent to the approval itself will not be possible. Any errors in the preview approved by the customer, whether spelling, typing, or more generally form errors, cannot be attributed to MISSPRINT, remaining the sole responsibility of the customer/buyer.
MISSPRINT will provide up to a maximum of 2 graphic previews for approval free of charge, beyond which it reserves the right to request a contribution of € 25 for subsequent processing.

7. PAYMENT TERMS AND METHODS
Payment must be made by bank transfer or credit card on the site www.missprint.it or other sites linked to it, as expressly indicated on the site page dedicated to this purpose. Confirmation of payment will start the next processing phase by MISSPRINT under the conditions set out above.
6. Cancellation or postponement of the order.

In the event of a reprint request, the minimum order quantity is 30 copies, and an additional €30.00 will be applied to the price.
8. SHIPPING OF THE FINISHED PRODUCT
MISSPRINT undertakes to deliver the finished product to the courier for shipping within 15 working days from the final approval of the digital sample. Shipping will be via national express courier, at a cost that varies based on the destination and that will be defined from time to time in the order confirmation. The customer may decide to insure the shipment, up to a total value of € 500 (VAT included), the cost of which will vary based on the destination. All shipping costs are borne by the customer, including shipments of any prototypes or modified samples.
9. OBLIGATIONS OF THE CUSTOMER/BUYER
For the purposes of this contract, the Customer declares, undertakes and guarantees:
1. to have the power and authority to enter into this Contract;
2. to be at least eighteen (18) years old;
3. to access and use all the Services provided by Missprint only and exclusively in accordance with this Agreement and the applicable laws.
4. During the execution of his order, the Customer (also known as the buyer) is to be considered the only person responsible for any violations of the rights of third parties, in particular copyright, of which rights he declares to be in possession for the purposes of duplication of reproduction of third party materials. Missprint is entirely excluded from any liability for cases of publication not expressly authorized by third parties, of texts entered by the Customer in any area, public, private or electronic.
It is understood that the Customer exonerates and undertakes from the outset to indemnify and hold harmless Missprint from any claims from third parties due to any violations of such rights.
10. RIGHT OF WITHDRAWAL
In compliance with the provisions of the "Consumer Code" and in particular art. 64, for contracts and contractual proposals at a distance or negotiated outside commercial premises, the buyer has the right to withdraw without any penalty and without specifying the reason, within ten (10) working days from receipt of the goods. The right of withdrawal is exercised by sending, within the terms provided, a written communication to the seller's headquarters by registered letter with acknowledgement of receipt. The communication can also be sent, within the same term, by telegram, telex, certified electronic mail and fax, provided that it is confirmed by registered letter with acknowledgement of receipt within the following forty-eight hours; the registered letter is considered sent in good time if delivered to the accepting post office within the terms provided by the code or the contract, where different. The acknowledgement of receipt is not, however, an essential condition for proving the exercise of the right of withdrawal. In the event of withdrawal and/or complaints promptly reported, the Customer is obliged to return, at his own expense, all the intact material, subject of the complaint and to compensate for the expenses and costs incurred by Missprint for the production of the product. In any case, Missprint's liability is limited to the reprinting or remaking of those articles in which there are errors or defects that make the finished product different from the preview of the model, sent by Missprint to the Customer and approved by the latter for printing and/or are such as to make the product completely unusable for use.
11. DEFECTS IN THE SUPPLY
The customer must report the existence of defects in the supply within 5 days from the date of delivery of the articles, by registered letter addressed to Missprint, Viale Antium, 6 00042 ANZIO RM. After this period, the articles are considered accepted. 1) Neutral products. Defects in the supply include items that do not conform to the order sent in terms of quantity, color, etc. 2) Customized products. Spelling errors or total illegibility of the logo or wording will be taken into consideration. In any case, it will be necessary to ship, at your own expense, the goods deemed not to conform to Missprint. Our subsequent check will establish whether the goods can be returned. If non-conformities are found, Missprint undertakes to agree with the Customer on the methods of reimbursement for the defective goods or possibly a new supply of the same amount. In the event that, once the goods have been received, we do not find any imperfections that justify a return, the goods will remain at our premises, awaiting collection by the Customer, after 30 days from receipt of the goods, if personalized, they will be disposed of.
Applicable law
The sales contract between the customer and Missprint is considered concluded in Italy and regulated by Italian law.
12. MISSPRINT'S RESPONSIBILITY
Missprint declines any liability towards its customers or third parties for delays, malfunctions, suspension and/or interruption in the provision of services caused by:
a) force majeure;
b) malfunction or non-conformity of the product;
c) dependent on disservices attributable to third parties of which the parties have availed themselves and who are independent of the dominion and control of Missprint and for which the respective general conditions of contract apply.
d) In any case, Missprint's liability is limited to the reprinting or remaking of those articles in which there are errors or defects that make the finished product different from the preview of the model, sent by Missprint to the Customer and approved by the latter for printing and/or are such as to make the product completely unusable.
13. EXPRESS TERMINATION CLAUSE
If 15 days have passed since the purchase request and the Customer has not made the payment in the manner indicated in point 5 of this agreement, the contract will be considered terminated by operation of law pursuant to and for the effects established and provided for by art. 1456 of the Italian Civil Code, without the need for notice.
14. COPYRIGHT
The Contractor reserves all copyright rights by order of the Customer, relating to graphic drafts, figurative trademarks, text, layout, photos, etc. The consideration paid for such work tends to cover the work provided, not the intellectual property rights, and in particular the right to any further reproduction made by third parties. The copyright may be transferred by Missprint to the Customer himself or to several customers without anyone claiming exclusivity. Copyright is also valid on products generated via the configurator. Detailed interventions, tending to the exclusive subjection of the graphic proposal, may be transferred to the client for a different exclusive fee. The Client may not legitimize any return by the Contractor of temporary materials such as: data, files, films, lithographs or zincographic plates, made to obtain the final product due. Anything not foreseen and/or agreed upon in the scope of the possible, practicable execution, may be realized by prior written agreement.
15. COMPETENT COURT
The competent Court is the Court of Velletri;
16. DOMICILE OF THE PARTIES
Any communication requested or permitted by the provisions of the contract must be made in writing and will be considered validly and effectively executed upon receipt of the same only if it is made by registered letter with return receipt, or electronically and provided that it is sent to the addresses (including email addresses) of the contractors indicated in the epigraph and at which they are considered domiciled for the purposes of this contract.
17. PRIVACY AND USE OF COOKIES ON THE WEBSITE WWW.MISSPRINT.IT
The personal data sent to Missprint will be processed, using both electronic and manual tools, in compliance with all security measures suitable for guaranteeing confidentiality and integrity, for the sole and exclusive purpose of responding in the best possible way to the request forwarded to us. All the requested data are to be considered mandatory, as they are necessary to allow us to process the orders forwarded by the Customer; in the absence of such data we will not be able to provide any type of service.
All data communicated by the interested parties (Customer) will be processed exclusively for fulfillment of the contract and in particular by way of example:
for the insertion of personal data into our databases;
for the processing of internal statistics;
for the creation of prototypes and/or any samples;
for the issuing of invoices and credit notes;
for the maintenance of ordinary accounting and VAT;
for the management of collections and payments;
for the sending of commercial information relating to our business or activities strictly connected or correlated;
to satisfy the obligations established by the laws, regulations, community legislation, civil, criminal and tax laws;
for the evasion of orders;
for shipping and/or delivery of the product.
For the purposes of the indicated processing, the non-sensitive data provided by the Customer and processed by us will not be communicated to third parties unless prior authorization is granted by the interested party. The interested party may at any time know what data we have about him/her and how it is used, request the cancellation, transformation into anonymous form or blocking of data processed in violation of the law as well as the updating, rectification or, if there is interest, integration of the data and oppose the processing itself.
Nature of the provision of data and consequences of any refusal to respond.
The processing will be carried out with manual and automated systems designed to store, manage and transmit the data, with logic strictly related to the purposes themselves, based on the data in our possession and with the commitment on your part to promptly communicate any corrections, additions and/or updates.
Within the scope of the processing described, knowledge and storage of information relating to personal data, tax code, VAT number, accounting data is necessary.
Any failure to communicate, or in any case incorrect communication, of one of the information indicated has the following consequences:
The impossibility of the owner to guarantee the congruence of the processing itself to the contractual agreements for which it is performed;
The possible lack of correspondence of the results of the processing itself to the obligations imposed by the legislation fiscal, administrative or labor to which it is addressed.
The data is stored at the operational headquarters of the organization, for the time prescribed by civil and fiscal regulations.
SCOPE OF COMMUNICATION AND DISSEMINATION OF DATA.
Your non-sensitive data may be communicated in order to allow the fulfillment of contractual or legal obligations:
to all subjects to whom the right to access such data is recognized by virtue of regulatory provisions;
to our collaborators, employees, agents and suppliers, within the scope of their relative duties and/or any contractual obligations with them, inherent to commercial relationships with the interested parties;
to post offices, shipping agents and couriers for the sending of documentation and/or material.
